This is a contract with S.C. HOST-AGE.RO GAZDUIRE WEB S.R.L. and must be accepted before ordering any service through the website http://www.host-age.com. Any order is considered confirmed by the client if the box “I agree with the Terms of Use” is checked and then by pressing the “Complete Order” button.
Chapter I. Object of the contract
Art. 1. The Provider ensures website hosting, domain registration, SSL certificates, or other web services ordered by the Client through the http://www.host-age.com website.
Art. 2. The duration of this contract is equal to the period for which the client chooses to pay for the ordered services. There is no minimum term; the Client may cancel the services offered by the Provider at any time.
Chapter II. Prices and payment conditions
Art. 3. The Client will pay the Provider the value of the services ordered through the online form. The Client can request service modifications at any time, and the new price will be reflected in future invoices issued by the Provider.
Art. 4. Payment to the Provider will be made by bank transfer or online by bank card based on the proforma invoice issued by the Provider. The proforma invoice is sent to the Client’s account email immediately after completing the order and 15 calendar days before the expiration of the prepaid period.
Art. 5. Payment for the next period must be made at least one day before the end of the current paid term. Hosting service is automatically suspended on the first day after expiration until payment is made. If payment is not made within 30 days from the end of the payment term, the account may be deleted along with all content.
Art. 6. The Provider may change prices for existing clients but only starting from the next invoice, never retroactively.
Art. 7. If the Client requests modifications/optimizations/updates not included in the subscription and accepted by the Provider, these will be charged at €50+VAT/hour, minimum one hour.
Chapter III. General service conditions, guarantees, and liabilities
Art. 8. The Provider guarantees that the service will be provided under normal operating conditions. Service availability is measured monthly, excluding maintenance periods. Normal operation means guaranteed service availability of 99.98%.
Art. 9. Maintenance periods will be scheduled preferably at night and will be announced in advance if expected to last more than 10 minutes.
Art. 10. If uptime is lower than guaranteed, the Provider agrees, upon Client request, to credit the Client’s account proportionally as follows: 10% for uptime between 99.98% and 99%, 25% for uptime between 99% and 98%, 50% for uptime between 98% and 95%, 75% for uptime between 95% and 90%, and 100% for uptime below 90%.
Art. 11. Except as above, the Provider is not liable for any damages attributed by the Client to improper service functioning.
Art. 12. The Provider is not responsible for service non-performance, degradation, or delay caused by (a) actions or omissions of the Client or third parties hired by the Client; (b) scheduled maintenance; (c) force majeure events; (d) suspension or deletion of accounts due to non-payment by the Client.
Art. 13. The Provider may claim damages from the Client for abusive, illegal, or fraudulent acts causing harm to the Provider or third parties. The Client is fully responsible for damages caused by non-compliant acts.
Art. 14. The Provider is not liable for damages, profit loss, or missed business opportunities related to the use of services. Liability is limited to one month’s subscription fee.
Chapter IV. General terms and conditions
Art. 15. The Internet network and Provider’s services must be used legally and appropriately. The Client is forbidden to use them for transmitting illegal, fraudulent, abusive, defamatory, or harmful content or for spamming.
Art. 16. The Provider is not responsible for content created, stored, or accessed through its services unless sent or requested by the Provider. The Provider reserves the right to monitor or remove illegal content as required by law.
Art. 17. The Client cannot send unsolicited messages (SPAM) or harass others using the Provider’s network or services.
Art. 18. The Client must not attempt unauthorized access, security breaches, service interference, or abuse of resources.
Art. 19. The Provider reserves the right to block IP addresses exhibiting suspicious activity (e.g., multiple failed logins, injection attempts, spam).
Art. 20. For violations, the Provider may issue warnings or suspend services temporarily or permanently, depending on severity and recurrence.
Art. 21. For severe or repeated violations (e.g., DoS attacks), the Provider may immediately suspend services and seek damages.
Art. 22. The Provider will inform the Client in writing about any decisions made.
Art. 23. Resource consumption. Each hosting account is monitored for CPU, RAM, concurrent processes, traffic, etc., to avoid affecting other accounts. Accounts exceeding limits may show error messages or be suspended without prior notice. Clients must optimize scripts or upgrade plans as needed.
Using CloudLinux, hosting packages have resource limits as follows:
– Basic package: max 100% CPU, 20 connections, 100 processes, 1GB RAM, max 50 emails/hour.
– Standard package: max 200% CPU, 80 connections, 140 processes, 2GB RAM, max 100 emails/hour.
– Medium package: max 300% CPU, 100 connections, 180 processes, 3GB RAM, max 200 emails/hour.
– Enterprise package: max 500% CPU, 120 connections, 220 processes, 5GB RAM, max 300 emails/hour.
Reseller accounts may use max 200% CPU, 50 connections, 100 processes, 2GB RAM, 200,000 files, and max 100 emails/hour.
Max throughput per account is 10MB/sec and 1024 IOPS.
Max files and folders per account: Basic – 100,000; Standard – 300,000; Medium – 400,000; Enterprise – 500,000.
Chapter V. Contract termination
Art. 24. Contract termination before term: (a) mutual written agreement; (b) contract conditions fulfilled; (c) legal impossibility to continue.
Art. 25. Unilateral termination conditions: (a) payment delay over 21 days; (b) fraud detection; (c) use of harmful scripts; (d) client may terminate anytime.
Chapter VI. Arbitration
Art. 26. Both parties agree to amicably resolve disputes per contractual provisions. Failure to meet obligations may lead to damages under Romanian law. If unresolved, disputes go to court with binding decisions.
Chapter VII. Force majeure
Art. 27. Force majeure means unforeseeable, uncontrollable events preventing contract fulfillment. Provider’s technical problems are not force majeure. The affected party must notify the other within 10 days with confirmation from the Chamber of Commerce.
Chapter VIII. Final provisions
Art. 28. This contract, mutually agreed, governs rights and obligations between parties.
Art. 29. Rights assignment: Client cannot represent or engage Provider toward third parties without express written consent.
Chapter IX. Domain registration and renewal
Art. 30. Domains with extensions other than .ro are registered only after payment is received. During this time, the domain is available to others, and Provider is not responsible for domain loss. Renewal proformas are sent 14 days before expiration. Non-payment may lead to quarantine with additional fees. .ro domain registration follows ROTLD rules.
Chapter X. Personal data protection
Art. 31. Provider collects Client personal data through the Website. Client should review the Privacy Policy and Cookies Policy.
Chapter XI. Promotions
Art. 32. Hosting package promotions apply only to new accounts, not existing ones. Domain promotions may apply to new and old clients unless stated otherwise. 50% hosting discount for culture, education, or humanitarian foundation sites
Host-Age.ro offers 50% off hosting for sites such as cultural, educational, museums, public libraries, research institutes, and humanitarian foundations, excluding sites with advertising banners or Google AdWords. Host-Age.com reserves the right to refuse discounts.
